Privacy policy

Last updated

This policy explains how FORJ Creative handles personal information when you use this website, send us an enquiry, work with us or otherwise deal with us. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

In short: we collect what you give us so we can reply and do the work, we use Google Analytics to understand how the website is used, we store enquiries in Wix, and we do not sell your information. You can ask to see or correct what we hold, or complain, using the details at the end of this page.

  1. Who we are

FORJ Creative is an Australian business based in Melbourne, Victoria. In this policy, "FORJ", "we", "us" and "our" mean FORJ Creative. You can contact us about privacy at info@forjcreative.com.au.

  2. What we collect

The personal information we collect depends on how you deal with us.

    When you send an enquiry
Your name, email address and phone number, and what you tell us about the project or business. For Interior Design enquiries this can include the project type, address or suburb, project status, approximate size, timing and whether a builder is appointed. For Digital enquiries it can include your business name, website, platform, current paid media, approximate monthly ad spend and timing. We also record which type of enquiry you sent and, if you tell us, how you heard about FORJ.
When you email or call us
Your contact details and whatever you choose to include in the message or conversation.
    When you become a client
Contact details for the people we work with, billing details such as business name, ABN and billing address, and project information such as briefs, plans, site details, photographs, approvals and correspondence.
    When you use the website
Technical information such as the pages you visit, how you reached the site, your device, browser and operating system, and your approximate location (city or region level). Google Analytics collects this using cookies (see below). Our hosting provider also receives your IP address when your browser requests a page, and our contact form uses it briefly to limit repeated submissions.
    Suppliers, contractors and job applicants
Contact and business details, and for applicants, the information in your application.

We do not ask for sensitive information, such as health information or information about your racial or ethnic origin, religion or political opinions. Please do not include it in an enquiry. If we receive information we did not ask for and do not need, we will delete or de-identify it where it is lawful and reasonable to do so.

You can ask us a general question without giving your full name. We need a way to contact you to reply, and we usually need to know who you are to provide services.

  3. How we collect it

Mostly directly from you: through our contact form, by email, by phone, in meetings and during a project. Some information comes from other people, such as a colleague who introduces you, a client who gives us your details as part of a project, or a public source such as your business website. Technical information about website visits is collected automatically by the services described below.

  4. Why we use it

    • to reply to your enquiry and talk with you about a possible project
    • to prepare proposals, provide our services and manage the project
    • to invoice, receive payment and keep business records
    • to manage our relationships with clients, suppliers and contractors
    • to understand how the website is used so we can improve it
    • to protect the website and our enquiry form from spam and misuse
    • to send occasional updates about our work, where you have agreed to receive them
    • to meet our legal obligations, and to establish or defend legal claims

We use your information for these purposes, for related purposes you would reasonably expect, or where the law allows or requires it.

  5. Services this website uses

These providers process personal information for us. They act under their own terms and privacy policies, which explain how they handle it.

    Wix (enquiries and contacts)
When you submit our contact form, your details are sent to Wix, which stores the enquiry, creates or updates a contact record for you and emails us a notification. Wix also hosts the content and images that appear on this website.
    Google Analytics (website use)
Google Analytics 4 tells us how the website is used: pages visited, how visitors arrived, device and browser, approximate location, and whether an enquiry was sent. It sets cookies in your browser. We use it to see aggregate patterns, not to identify individual visitors.
    Vercel (hosting)
Vercel hosts the website and runs our contact form. Like any web host, it receives your IP address and request details when you load a page. We also use Vercel Speed Insights to measure page performance. Vercel says Speed Insights is anonymous and is not tied to an individual visitor or IP address.

This website does not currently use Google Ads conversion tracking, the Meta Pixel or other advertising tags. If we add them, we will update this policy before or when we do. The website's fonts are hosted with the site, so loading a page does not send your details to a font service.

  6. Cookies and how to control them

Google Analytics uses first-party cookies (named _ga and _ga_ followed by an ID) to tell visits apart and to recognise a returning browser. They do not contain your name or contact details.

You can block or delete cookies in your browser settings, and the website will still work. You can also stop Google Analytics collecting data about your visits with Google's opt-out browser add-on: tools.google.com/dlpage/gaoptout

  7. Who we share it with

We do not sell or rent personal information. We share it only as needed with:

    • the service providers named above, and providers we use to run the business, such as email, file storage and accounting software
    • contractors and specialists who help us deliver your project, under confidentiality obligations
    • people you ask us to share it with, or who are involved in your project with your knowledge, such as your builder or other consultants
    • our professional advisers, such as accountants, lawyers and insurers
    • government bodies, regulators or others where the law requires or authorises it
    • a buyer or successor of the business, if FORJ is sold or restructured, on the basis that they handle it in line with this policy
  8. Overseas storage and disclosure

Some of our providers store or process information outside Australia. Wix keeps data in data centres in the United States and Ireland and may process it in other countries. Google processes Analytics data in the United States and other countries where it operates. Vercel runs the website's server functions in the United States by default and may process data in other countries where it operates. Other business software we use may also store data overseas.

We choose established providers that publish their security and privacy practices, and we take reasonable steps to make sure overseas recipients handle personal information consistently with the Australian Privacy Principles.

  9. How we store and protect it

We store personal information in the cloud services described above and in our business email and file storage. We protect it by limiting access to the people who need it, using accounts with strong passwords and multi-factor authentication where available, using encrypted (HTTPS) connections on the website, and choosing providers that maintain security controls. No system is completely secure, so we cannot guarantee that information will never be accessed without authorisation.

We keep personal information only for as long as we need it for the purposes in this policy, including to keep business, tax and project records the law requires us to keep. When we no longer need it, we take reasonable steps to delete or de-identify it.

  10. If there is a data breach

If we become aware that personal information we hold may have been lost or accessed or disclosed without authorisation, we will act quickly to contain it and assess the risk of harm. Where a breach is likely to result in serious harm, we will notify the people affected and the Office of the Australian Information Commissioner (OAIC) where the Notifiable Data Breaches scheme requires it, and tell you what you can do to protect yourself.

  11. Marketing emails

We only send marketing emails or messages if you have agreed to receive them, or where the law otherwise allows, for example to an existing client about related work. Every marketing email identifies FORJ and includes a way to unsubscribe. If you unsubscribe or ask us to stop, we will do so within five working days. Replies to your own enquiry and messages about an active project are not marketing.

  12. Automated decisions

We do not use computer programs to make decisions about you that could significantly affect your rights or interests. A person at FORJ reads every enquiry and decides how to respond.

  13. Information we handle for clients

In some projects, a client gives us access to information about their own customers or staff, for example through their website platform, CRM, advertising or analytics accounts, or a customer list for an email campaign, or a staff list for a workplace plan. We use that information only to do the work the client has engaged us for, on the client's instructions and under our agreement with them. The client's own privacy policy explains how they handle it.

  14. Accessing and correcting your information

You can ask for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. You can also ask us to delete it. Email info@forjcreative.com.au. We may need to confirm your identity first.

We aim to respond within 30 days. If we refuse a request, for example where the law allows us to keep the information, we will tell you why in writing and how to complain. We do not charge for a request to correct information. We will not charge for access unless the request is unusually large, and we will tell you before we incur any cost.

  15. Making a complaint

If you think we have mishandled your personal information, please email info@forjcreative.com.au with the details. We will acknowledge your complaint, look into it and respond in writing, aiming to do so within 30 days.

If you are not satisfied with our response, or we have not responded within 30 days, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by phoning 1300 363 992.

  16. Changes to this policy

We will update this policy when the way we handle personal information changes, for example if the website starts using a new service. The current version is always on this page, with the date it was last updated.
